I think law is producted by morals, but isn't a part of it. It is meant to make men behave according to morality, but doesn't deal with their being moral or nor. To obey the law is moral only if you do this by yourself, not because you fear the punishment and, in a way, not because you care about the law, for you are intimately convinced that you must behave this way. Kant has an expression for that, but I don't remember it...
If you consider that to be moral is to be free, conscious and responsible, law has nothing to do with it, for it obliges men to behave in a special way, without really explaining them why, and then, doesn't make them responsible even of their good behaviour, for they only follow the rules ; they have no merit. |
