Conspiracy Theory

When Congress passed the Racketeer Influenced and Corrupt Organizations Act (RICO) in the 1970s, its goal was to stop the effects of organized crime on the nation's economy. The Act has since emerged as another area of potential liability for employers. Recently, RICO charges have been leveled against employers accused of violating federal immigration laws.

Case in point: Four employees claimed that their employer conspired with temp agencies and recruiters to hire illegal aliens in an attempt to suppress wages.
According to the class action lawsuit, the company recruited illegal aliens along the Mexican border, relocated them, accepted false documentation as proof of eligibility for employment, and assisted them in evading detection during raids by the Immigration and Naturaoization Service (INS). Because they were so ependent on the employer, the illegal workers accepted lower wages, thus lowering the wages of all workers in the company.

A federal court ruled there was evidence that the company and its recruiters worked together to recruit illegal workers and they had the "common purpose" of providing illegal workers so that the employer could reduce costs. (Williams v. Mohawk Industries. Inc., 11th Cir., No. 04-18740, 2005)

IMPLICATIONS FOR YOU
The results of this case may result in the next wave of class action lawsuits. Here's why.

Employers located in areas with growing immigrant worker populations may be potential targets for this type of RICOclaim. Based on the results of this case, an employer could be held liable for the criminal acts of a low-level supervisor or a staffing agency, even if it wasn't directly involved. Although the employer in Williams allegedly worked closely with recruiters to hire illegal aliens, this case goes to show that standard arrangements between an employer and recruiter such as paying bonuses for temps who are ultimately hired as regular employees, could also land an employer in legal hot water for engaging in a criminal enterprise under RICO by directing criminal violations of the immigration laws - even if the employer was unaware of the recruiter's purpose of providing illegal workers.

With that in mind, employers that work with recruiters and staffing agencies shold become more involved in the process. Establish policies, contract terms, and
communications that can be used as evidence that you are doing everything by the book so employees can't allege conspiratorial actions.
