Well that's an interesting question and I guess the court has judged a specific case, which means it is not an absolute decision.
To me the question "Is atheism a religion" has a different answer following why you chose to be atheist. And what you consider being an atheist is... It also depends on how it affects the way of life and people acts.
There are several reasons why someone can be atheist.
For example: if you are atheist because you reject every other religion (and/or disagree with them), or because you just don't feel concerned enough by religious belief to follow their way of thinking, it is completely different.
